Semences Beauregard Inc. (hereinafter "Semences Beauregard") is a company specialized in seeds for agricultural producers located in Montérégie and Centre-du-Québec.

Our goal at Semences Beauregard is to serve the best interests of our customers. The privacy of our customers and the protection of their personnel information is very important to us, which is why we comply with the most rigorous rules regarding the protection of personal information.

What is the Confidentiality Policy?

The purpose of this Confidentiality Policy (hereinafter the "Policy") is to help you understand Semences Beauregard's collection, use, communication, retention and destruction of your personal information. We take the confidentiality of the personal information you provide to us seriously.

When you provide us with personal information, you consent to the processing of that information in accordance with this Policy and you also authorize Semences Beauregard and its service providers to process your personal information for the purposes set out in this Policy.

Semences Beauregard is solely responsible for the processing your personal information. Unless otherwise specified, Semences Beauregard determines the purposes for which and how the personal information held will be processed.

Collection of personal information

  • Identification documents: copy of driver's license, health insurance card, passport;
  • Billing and financial information: billing address, bank details, payment data;
  • Consent: when such consent is required for the processing of personal information;
  • Marketing, communication and website usage preferences: communication preferences, comments and surveys you respond to, consent preferences, information collected through cookies, website visits and content reading, IP address, network information;
  • Recruitment information: resume, references from previous employers, information on previous jobs, professional affiliations;
  • Public information: from social networks or public websites, interactions on social networks;
  • Any other personal information provided;

Your personal information is only collected when you provide it to us voluntarily.

Collection method

Most of the personal information is collected from you directly during our exchanges for the provision of services, as well as during your visits on the website, your communications with our office by any means and your registrations for the various activities organized by Semences Beauregard.

Information may also come from other professionals working with you, depending on the information sought, in which case you will be asked for explicit consent to obtain the desired information from the third party.

Use of personal information

Personal information is used for the following purposes, where applicable:

  • For the provision of services: to conduct our business, to administer and perform our services, including fulfilling our obligations under a contract between you and us;
  • To prevent fraud: background checks, disclosures required by law or regulation, transmission of information to law enforcement agencies when required by law;
  • To collect: ensure that invoices are paid for services rendered;
  • As part of a corporate reorganization: in the event of a reorganization of Semences Beauregard, we may be required to transmit information as part of a due diligence undertaken by the other company;
  • For supplier management: management of services received by service providers;
  • To comply with regulations: to meet our legal, regulatory and risk management obligations, including, for example, conflicts of interest, perform due diligence on customers;
  • For events, marketing and business development: to organize events, inform you of new services offered, invite you to events that may interest you;
  • For recruitment: to enable us to analyze a submitted application and the skills of the applicant, to enable the recruitment process to run smoothly;
  • For use of the website: to ensure that the content put online is relevant, the ways in which visitors use the website, ensuring that the presentation of online content is functional for the different connection methods used.

As part of the administration of a survey, contest and/or promotion, Semences Beauregard may use, subject to any refusal expressed by you, personal information, as provided to us on a voluntary basis, by sending messages or because of a participation in a survey, contest or promotion. The information collected for this purpose will be used primarily to contact you if you win. Contests and/or promotions offered by Semences Beauregard may be subject to special rules that will be more fully described at the launch of any contest or promotion.

Semences Beauregard will not use personal information collected in accordance with this Policy or applicable legislation for any other purpose, except with your prior consent or in exceptional circumstances when permitted or required by law.

Communication of personal information

The personal information provided may be shared, in particular with the parties identified below. The information communicated will be for the sole purpose of fulfilling the primary and legitimate purpose for which it was collected or for purposes consistent with that purpose, and only necessary information will be communicated:

  • To Semences Beauregard employees: when required for human resources recruitment or other purposes;
  • To our service providers: These may include our IT service providers, data hosting services and others. They may have access to personal information or may have to process it, depending on the services provided. Only the information strictly necessary to fulfill their contractual obligations is provided to them. Each service provider has undertaken, in writing, to respect the confidentiality of data received or encountered;
  • To government authorities or law enforcement agencies: this may arise from laws that require the disclosure of certain information, if such disclosure is required by law or if the disclosure is made in good faith to comply with a legal requirement or in response to a court order, subpoena, search warrant or to cooperate with government authorities or law enforcement agencies;
  • The acquirer or assignee of Semences Beauregard: when required as part of a reorganization of Semences Beauregard's activities, for any merger, acquisition, financing, sale of assets, in case of insolvency, bankruptcy, for which this personal information could be considered as commercial assets;

In addition to the foregoing, Semences Beauregard will not disclose to third parties any personal information collected in accordance with this Policy or applicable legislation, except with your prior consent or in certain exceptional circumstances where the law permits the disclosure of personal information without prior consent.

Retention of personal information

Personal information is retained only as long as necessary for the purposes set out in this Policy, and in accordance with our legal and regulatory obligations. Personal information is kept for a period of 3 to 7 years after the purposes mentioned herein have been fully achieved.

Protection of personal information

Your personal information is protected in accordance with applicable regulations, notably by physical, technical and administrative protections that limit the risk of unauthorized access to your personal information. Your information is therefore protected against theft, accidental loss or destruction, unauthorized use or access, modification or any other prohibited processing of personal information.

As a result, only staff members who need to have access to or knowledge of personal information, or whose duties require them to have such knowledge, have access to it.

Your data is hosted in Canada. The regulations in force for data protection are those of the place where the data is hosted. Obligations are therefore those set out in the laws and regulations in force in Canada regarding the protection of personal information. Our practices are governed by this Policy and the laws governing it.

Please be advised that no communication of personal information over the Internet and no electronic storage is 100% secure. Semences Beauregard cannot guarantee the security of any information transmitted in this manner and you do so at your own risk. Semences Beauregard also cannot guarantee that said personal information will not be consulted, destroyed, modified or disclosed despite the protection put in place.

The rights of the person concerned by the personal information

In accordance with current laws and regulations concerning the protection of personal information, if the company holds personal information about you, you have rights regarding your personal information. To exercise your rights, please refer to the "Contact us" section for the contact information of Semences Beauregard's Person in charge of the protection of personal information.

In accordance with applicable laws and regulations, you have the following rights:

  • Access: You may request access to the personal information we hold about you. Upon receipt of your request for access, Semences Beauregard's Person in charge of the protection of personal information will review the personal information held and send you a copy of the information held, subject to applicable law and payment of the applicable fee;
  • Rectification: You have the right to request that any information about you that is inaccurate, or incomplete be rectified. Current legal obligations require us to take reasonable steps to ensure that the personal information we hold about you is accurate, complete and up-to-date;
  • Withdrawal of consent: at any time, you have the right to withdraw your consent to the use and communication of your personal information;
  • Right to be forgotten: you have the right to demand that the dissemination of your personal information cease or to request that it be de-indexed from any hyperlink attached to personal information and allowing access to it by a technological means;

Any person whose personal information is held by the company may submit a complaint. To do so, you must send your complaint to Semences Beauregard's Person in charge of the protection of personal information, whose contact information is listed in the "Contact Us" section of this document.

When filing a complaint, the person concerned must describe the subject of the complaint and the corrective action requested. Once the complaint has been received, the Person in charge of the protection of personal information will contact the person concerned to discuss the file and ensure that he or she has all the information or documents required to analyze the complaint. Following examination of the complaint, a final written response will be sent to the person who filed the complaint within ninety (90) days of receipt of the complaint.

Complaints must be made in writing to the Commission d'accès à l'information by the person concerned when he or she believes that the law has not been respected. The Commission d'accès à l'information will analyze the complaint and may proceed with an inspection or investigation, if necessary.

Minor

The authorization of a parent or guardian is required for a person under eighteen (18) years of age (hereinafter a "Minor") to participate in any activity organized by Semences Beauregard, including any survey, contest or promotion. In the event that such activity is specifically intended for a Minor, the authorization of a parent or guardian will be expressly required for a child under fourteen (14) years of age.

Semences Beauregard will not collect or use any personal information from a Minor under the age of fourteen (14) without the consent of a parent or guardian.

Policy update

We reserve the right to change this Policy at any time without notice. We encourage you to periodically review this Policy to stay informed about how we are protecting your information.
